Amendments to the Law on Patent Attorneys

The Government of the Russian Federation adopted the law introducing amendments to the regulation of Patent Attorneys’ activities.

These are the main changes to the law on Patent Attorneys:

– patent attorneys are authorized to access to Rospatent’s information resources containing information on IP rights and to request information required for complying with the client’s instructions from the government bodies.

– the concept of client-attorney privilege is defined; the information obtained from the client is considered to be confidential.

– the situations of conflict of interest are specified, when a patent attorney has no right to accept instructions from the client.

– requirements to patent attorney candidates are defined.

The law will take effect on December 21, 2022.
