New rules of arbitration hearings

The Plenum of the Supreme Court of the Russian Federation adopted the Resolution ‘On application of the Arbitration Procedure Code when considering cases in the first-instance court’, where the rules of judicial process in the arbitration court are clarified.

New Resolution totally replaces clarifications of the Plenum of the Supreme Arbitration Court adopted in 1996.

New clarifications of the Plenum help lawyers to better prepare for arbitration hearings in the first-instance courts. The Supreme Court teaches how to determine the jurisdiction of the dispute correctly and explains when the additional requirements to the claim can be submitted. It is permitted for the lawyers not to present a certified copy of the diploma to the court, also, it is determined that paralegal assistants do not have the same procedural rights as the lawyers.
