Successful representation of the client’s interests in a trademark cancellation case

ARS-Patent represented the interests before the Court for Intellectual Property Rights of the German company AMAZONEN-WERKE Н. Dreyer SE & Co. KG, a large-scale producer of agricultural machinery.

In the result of the examination of the international registration by the Russian Patent and Trademark Office, our client received a refusal on legal protection on the territory of the Russian Federation in view of the earlier trademark registration. It was decided to file a lawsuit for cancellation of the opposed trademark registration due to its non-use in the classes 07 and 09.

In the frame of the case SIP-602/2022, the Court for Intellectual Property Rights issued a decision in favor of our client, having satisfied the lawsuit in full.

The interests of the company AMAZONEN-WERKE Н. Dreyer SE & Co. KG in the case were represented by the Head of Legal Department of ARS-Patent – Kirill Osipov.
